Thư đồng ý với thỏa thuận lợi ích cộng đồng cho dự án Đường sắt cao tốc California

Những người ký tên dưới đây xác nhận và đồng ý rằng:

1. Nó là C / S / E vì thuật ngữ đó được định nghĩa trong Mục 1.6 của Thỏa thuận Quyền lợi Cộng đồng Đường sắt Cao tốc California (“Thỏa thuận”) vì nó đã hoặc sẽ được trao một hợp đồng hoặc hợp đồng phụ để chuyển nhượng, trao hoặc hợp đồng phụ Công việc Dự án trong Dự án, hoặc ủy quyền cho một bên khác giao, trao hoặc thầu phụ Công việc Dự án, hoặc thực hiện Công việc Dự án.
2. Khi xem xét việc trao hợp đồng hoặc hợp đồng phụ đó, và xem xét thêm những lời hứa được đưa ra trong Thỏa thuận và tất cả các tài liệu đính kèm theo đó (một bản sao của hợp đồng hoặc hợp đồng phụ đó đã được chấp nhận và đồng ý bị ràng buộc bởi các điều khoản và các điều kiện của Thỏa thuận, cùng với bất kỳ và tất cả các sửa đổi, bổ sung hiện đang tồn tại hoặc sau này được thực hiện theo đó.
3. Nếu nó thực hiện Công việc Dự án, nó sẽ bị ràng buộc bởi các thỏa thuận ủy thác được thiết lập hợp pháp được chỉ định trong các thỏa thuận thương lượng tập thể tổng thể tại địa phương và theo đây ủy quyền cho các bên của thỏa thuận ủy thác địa phương đó để chỉ định người được ủy thác và người được ủy thác kế nhiệm để quản lý quỹ ủy thác, và theo đây phê chuẩn chấp nhận những người được ủy thác được chỉ định như thể được thực hiện bởi những người ký tên dưới đây.
4. Nó không có cam kết hoặc thỏa thuận nào ngăn cản việc tuân thủ đầy đủ và hoàn toàn các điều khoản và điều kiện của Thỏa thuận.
5. Nó sẽ đảm bảo một Thư đồng ý được thực thi hợp lệ, có hình thức giống với tài liệu này, từ bất kỳ C / S / E nào ở bất kỳ cấp nào hoặc các cấp mà nó ký hợp đồng để chuyển nhượng, trao hoặc thầu phụ Công việc Dự án hoặc để ủy quyền cho người khác bên giao, trao hoặc thầu phụ Công việc Dự án, hoặc để thực hiện Công việc Dự án.
