Small Business Program – Good Faith Effort Guidance

To ensure small businesses are afforded every practicable opportunity to participate in the Authority’s contracting and procurement program, prime contractors must make demonstrable efforts toward meeting applicable SB, DVBE, and DBE goals. Under federal guidelines for DBE goal achievement, these efforts are known as Good Faith Efforts (GFE).

The Authority has established its guidelines, herein known as Efforts Toward Achievement (ETA), to increase SB and DVBE participation in the high-speed rail project. These efforts, GFE and ETA, are collectively known as Efforts to Achieve Participation (EAP), as outlined in the current Small Business Program Plan.

The following document provides further clarity and guidance, outlining the types of EAP recognized by the Authority and the criteria needed to approve said efforts:

Prime Contractor Payments

The Small Business Team posts payments prime contractors receive for work performed on the high-speed rail project. Prime contractors include:

  • Design-build teams, who are constructing the first 119 miles of high-speed rail in the Central Valley
  • Project and Construction Management (PCM) teams for Central Valley construction packages
  • Aecom-Fluor Team, our Project Delivery Support
  • Regional Consultants, who help the Authority with environmental work required for compliance with the California Environmental Quality Act and the National Environmental Policy Act; and preliminary engineering documents required for procurement

Small Business Contracts & Expenditure Reports

To provide transparency to the taxpayers of California, the Small Business Compliance Unit posts Prime and Small Business Contracts and Expenditure (C&E) Reports, monthly, in relation to its Small Business goals for state and federally funded contracts. C&E Reports include:

  • Current Total Contract Value
  • Amount Paid to Date to Prime Contractors
  • Amount Paid to Small Businesses by Prime Contractor
  • Small Business Utilization based on Total Contract Value
  • Small Business Utilization based on Amount Paid to Prime by the Authority

Small Business Contracts & Expenditure by Certifications Reports

To date, while the Authority is not a certifying agency, it recognizes the certifications below by their respective agencies:

  • Small Business and Small Business for Public Works (SB) – CA Department of General Services
  • Microbusiness (MB) – CA Department of General Services
  • Disabled Veterans Business Enterprise – CA Department of General Services
  • Disadvantaged Business Enterprise – US Department of Transportation

Small Business Utilization Reports

The Small Business Utilization Report is a detailed document that captures reported small business data on a monthly basis. Information provided in the report includes current revenue and utilization percentages for Design-Build and Professional Services contracts, the number of certified firms currently performing work on the project broken down by certification type and location, and job numbers inclusive of disadvantaged worker data. The report will be made available each month.

Underutilized Small Business Data

To provide transparency to the taxpayers of California, the Small Business Compliance Unit posts the Underutilization percentages of each small business with current agreements with HSR Prime Contractors. Underutilization is defined as any percentage not at 100% of the contracted amount. Percentages are calculated by dividing the total agreed amount to the current cumulative total paid to date to the small businesses by their Prime Contractor.

The underutilization of small businesses is not always a direct compliance violation, as Prime have until the end of the agreement to fully utilize their SBs. However, underutilization is monitored closely to ensure small businesses are being provided the work primes have agreed to subcontract. USB data includes:

  • Current Total Contract Value
  • Amount Paid To Date to Prime Contractors
  • Amount Paid to Small Businesses by Primes
  • Small Business Utilization based on Total Contract Value
  • Small Business Utilization based on Amount Paid To Prime by HSR
  • Contract/Utilization Notes

Small Business Assistance

Do you have a small business issue or concern? Submit Small Business contract compliance and dispute resolution inquires, via the High-Speed Rail Authority Small Business Assistance form.

The Small Business Assistance form provides small businesses a convenient way to call attention to issues or concerns. Submittals will be sent directly to our Small Business Advocate for review and assignment to appropriate HSR staff.

The Small Business Assistance Form can help facilitate the following:

  • Appeal decisions made by the California High-Speed Rail Authority;
  • Investigate issues with a California High-Speed Rail Authority contractor;
  • Report concerns regarding payment;
  • Escalate concerns regarding small business utilization;
  • Request general Small Business Program information; and more.
