FRESNO TO BAKERSFIELD: LOCALLY GENERATED ALTERNATIVE

Combined Supplemental Record of Decision and Final Supplemental Environmental Impact Statement

The California High-Speed Rail Authority (Authority) has prepared this combined Supplemental Record of Decision (Supplemental ROD) and Final Supplemental Environmental Impact Statement (Final Supplemental EIS). The Supplemental ROD is the Authority’s approval, as federal NEPA lead agency under NEPA assignment, of the Fresno to Bakersfield’s Locally Generated Alternative (F-B LGA) as described in the Final Supplemental EIS dated 31 October 2019. The Supplemental ROD is combined with the Final Supplemental EIS pursuant to Section 1311 of the FAST Act (49 U.S.C. § 304a(b)). As to NEPA assignment, the environmental review, consultation, and other actions required by applicable Federal environmental laws for this project are being or have been carried out by the State of California pursuant to 23 U.S.C. 327 and a Memorandum of Understanding dated July 23, 2019, and executed by the Federal Railroad Administration and the State of California.

The Draft Supplemental EIR/EIS was prepared as a CEQA/NEPA joint document with the Authority as the CEQA lead agency and the Federal Railroad Administration (FRA) as the NEPA lead agency. The Draft Supplemental EIR/EIS was issued for public comment by both agencies in November 2017. The comment period closed in January 2018.

Subsequently, the Authority decided to separate the CEQA process from the NEPA process. Accordingly, the Authority as CEQA lead agency prepared a Final EIR. The Authority Board, acting in its capacity as CEQA lead agency, certified the Final EIR and approved the F-B LGA in October 2018.

In July 2019, the Authority received NEPA assignment from the FRA, as noted above. The Authority, now as NEPA federal lead agency, has finalized the NEPA process for the F-B LGA. The Draft Supplemental EIR/EIS stated that the Supplemental Record of Decision would be combined with the Final Supplemental EIS , which the Authority has now done.

Final Supplemental EIS: The Final Supplemental EIS consists of the Draft Supplemental EIR/EIS (previously circulated for public review and comment in 2017), comments and responses to comments on the Draft Supplemental EIR/EIS, and text changes and correction to the Draft Supplemental EIR/EIS (Errata). The comments and responses to comments on the Draft Supplemental EIR/EIS, and text changes and correction to the Draft Supplemental EIR/EIS (Errata), are available on the web at the links below.

The 2017 Draft Supplemental EIR/EIS is available via CD/DVD by contacting us at central.valley@hsr.ca.gov or (916) 324-1541. We will send it immediately free of charge via priority mail, upon request. The Draft Supplemental EIR/EIS is also available for viewing at the area repositories listed below (including the Authority’s Fresno and Sacramento offices). The 2017 Draft Supplemental EIR/EIS was prepared, produced and formatted prior to a recent California law requiring all documents posted on state websites to meet certain accessibility standards. That Draft Supplemental EIR/EIS is undergoing conversion to satisfy these standards, and will be posted on the Authority’s website when that conversion is completed.

Supplemental ROD: The Supplemental ROD is the Authority’s approval, as NEPA lead agency, of the F-B LGA as described in the Final Supplemental EIS dated October 31, 2019. The Supplemental ROD sets forth that the F-B LGA best serves the purpose and need for this project and minimizes economic, social, and environmental impacts. In addition to a summary of potential effects, the Supplemental Record of Decision includes the following findings for and/or discussions about:

  • Section 106 of the National Historic Preservation Act
  • Section 4(f) of the Department of Transportation Act of 1966
  • Section 7 Endangered Species Act
  • Section 404 Clean Water Act Least Environmentally Damaging Practicable Alternative
  • Wetlands pursuant to Executive Order 11990
  • Floodplains pursuant to Executive Order 11988
  • Environmental Justice pursuant to Executive Order 12898

The appendices to the Supplemental ROD include the Least Environmentally Damaging Practicable Alternative concurrence letters (under Section 404), State Historic Preservation Officer Section 106 concurrence letter, General Conformity confirmation correspondence, the Mitigation Monitoring and Enforcement Plan, letter from the City of Bakersfield concurring with the Section 4(f) de minimis impact finding, and the U.S. Fish and Wildlife Service’s Biological Opinion amendments for the Buena Vista Lake ornate shrew and for the Locally Generated Alternative.

The Supplemental EIS to the 2014 Fresno to Bakersfield Section Final EIR/EIS evaluates the potential environmental impacts from a new project alternative, generally between Shafter and a station in Bakersfield known as the F-B LGA. The F-B LGA provides an alternative alignment for a 23.13-mile segment of the Fresno to Bakersfield Section between the City of Shafter and the City of Bakersfield. The F-B LGA high-speed rail passenger station would be located at the intersection of State Route (SR) 204 and F Street in Bakersfield. A maintenance of infrastructure facility (MOIF) would be located along the F-B LGA in northern Shafter between Poplar Avenue and Fresno Avenue. It also compares those LGA-specific environmental impacts with the environmental impacts from the corresponding portion of the alignment evaluated south of Poplar Avenue in the 2014 Fresno to Bakersfield Section Final EIR/EIS (i.e., May 2014 Project). Fresno to Bakersfield Locally Generated Alternative: Combined Supplemental Record of Decision and Final Supplemental Environmental Impact Statement

Volume I – Report

Chapter 1.0, Project Purpose, Need, and Objectives, explains why the project is proposed and provides a history of the planning process that led to the development of the F-B LGA.

Chapter 2.0, F-B LGA Description, describes the California High-Speed Rail Project Background, Fresno to Bakersfield Section Final EIR/EIS Background, and development of the F-B LGA and F-B LGA F Street Station. This chapter explains that the F-B LGA will be compared to the May 2014 Project that was evaluated in the completed Fresno to Bakersfield Section Final EIR/EIS. The F-B LGA and its design options are described in Chapter 2, with visual representations (illustrations and maps) for the reader. Chapter 2 also describes modifications of Caltrans/State Facilities; travel demand and ridership forecasts; operations and service plans; additional high-speed rail development considerations; construction plan and phased implementation strategies; and permits and approvals.

Chapter 3.0, Affected Environment, Environmental Consequences, and Mitigation Measures, is where the reader can find information about the existing transportation, environmental, and social conditions in the area of the F-B LGA. This chapter provides the findings of the analysis of potential environmental effects, along with identification of measures to mitigate the effects (called mitigation measures).

Chapter 4.0, Section 4(f)/Section 6(f) Evaluation, provides the analysis under Section 4(f) of the Department of Transportation Act of 1966 and Section 6(f) of the Land and Water Conservation Fund Act.

Draft Supplemental Environmental Impact Report/Statement (EIR/EIS)

The California High-Speed Rail Authority (Authority) and Federal Railroad Administration (FRA) have prepared this Draft Supplemental Environmental Impact Report/Environmental Impact Statement (Draft Supplemental EIR/EIS) to supplement the Final EIR/EIS for the Fresno to Bakersfield project section of the California High-Speed Rail Project Final EIR/EIS. When the Final EIR/EIS was certified in May 2014, and a “Preferred Alternative” identified, the Authority elected to defer an alignment decision in the Bakersfield area, whereas the FRA approved the Preferred Alternative in its entirety. This Draft Supplemental EIR/EIS identifies a new alternative for the Fresno to Bakersfield project section. The Fresno to Bakersfield Locally Generated Alternative (F-B LGA) provides an alternative alignment for a 13-mile segment of the Fresno to Bakersfield project section between the City of Shafter and the City of Bakersfield. The F-B LGA station would be located at the intersection of State Route (SR) 204 and F Street. A maintenance of infrastructure facility (MOIF) would be located along the F-B LGA in northern Shafter between Poplar Avenue and Fresno Avenue.

Submitting a Comment

On November 9, 2017, the Califonia High-Speed Rail Authority (Authority) and the Federal Railroad Administration (FRA) jointly released, for public review and comment, a Draft Supplemental Environmental Impact Report/Environmental Impact Statement (Draft Supplemental EIR/EIS) for the Fresno to Bakersfield project section of the California High-Speed Rail Project. This Draft Supplemental EIR/EIS is focused on the portion of the alignment that runs from Poplar Avenue in Shafter to Oswell Street in Bakersfield. The Draft Supplemental EIR/EIS provides a comparison of two alternatives, the Fresno to Bakersfield Locally Generated Alternative and the May 2014 Project Alternative.

The official comment period begins Thursday, November 9, 2017 and closed on Tuesday, January 16, 2018.
